Am I entitled to sue if I am injured on the job?

The Labor Law in the State of New York protects all workers who are involved in the construction, alteration of demolition of any sort of structure. If you are injured in a fall from a ladder or a scaffold, or due to some unsafe or dangerous condition on a construction site, the owner and/or general contractor of that site may be responsible for your injuries.

What is the interplay, if any, between workers’ compensation benefits and a lawsuit?

If you are injured in the course of your employment on a construction site, you are entitled to receive workers’ compensation benefits from your employer. You are also entitled to sue the owner and/or general contractor of that site for your injuries. If you recover money for your injuries in a court of law, you may be required, depending on the circumstances, to reimburse your workers’ compensation carrier a percentage of whatever it paid out on your behalf in the way of medical bills and/or lost wages.
