NY’s Child Victims Act Allows all Victims regardless of age to Seek Civil Action until August 14th, 2021

Child molestation is one of the most horrid and insidious crimes imaginable. It is a crime so low that even other hardened criminals view it with disgust. The physical abuse is bad enough, but the emotional damage from child abuse can last a lifetime, often well into adulthood.

The sense of outrage felt by the families of the victims and the public increases exponentially when the perpetrators of such horrid crimes are teachers, coaches, priests or other authority figures that we entrust with positively influencing our children. This is an obscene violation of trust, made even worse by the fact that with this type of abuse, the victim is often afraid to report it, so it happens over and over again.

New York’s Child Victims Act

What you need to know about the new law:

  • It extends New York’s statute of limitations to allow for criminal charges against sexual abusers of children until their victims turn 28 for felony cases, up from the current 23.
  • It allows victims to seek civil action against their abusers and institutions that enabled them until they turn 55.
  • It opens up a  “Look Back”, one-time-only period (August 14, 2019 through August 14th, 2021) to allow all victims to seek civil action against their alleged abusers and the institutions that allegedly protected the abusers, regardless of how long ago the abuse occurred.
